Bathtub Shell, Frame, Finish- Limited Lifetime Warranty: Subject to the terms and conditions herein, Safe Step Walk-In Tub Co. warrant to you, the original purchaser, that your Safe Step walk-in tub shell, aluminum frame, and finish will not fade, crack, delaminate, or blister for so long as you own and reside at the residence where the Safe Step walk-in tub has been installed, subject to the exceptions, limitations, disclaimers, and other terms and conditions contained this document.

Door Seal – Limited Lifetime Warranty: Subject to the terms and conditions herein, Safe Step Walk-In Tub Co. warrants to you, the original purchaser, that your Safe Step walk –in tub door seal will not fail or become inoperable so long as your own and reside at the residence where the Safe Step walk-in tub has been installed, subject to the exceptions, limitations, disclaimers, and other terms and conditions contained in this document.

10-Year Limited Warranty: Subject to the terms and conditions herein, Safe Step Walk-In Tub Co. warrants to you, the original purchaser, that your water pump, blower and in line heater will not fail or become inoperable for ten years so long as your own and reside at the residence where the Safe Step walk-in tub has been installed, subject to the exceptions, limitations, disclaimers, and other terms and conditions contained in this document.

Other components of you Safe Step walk-in tub may be covered by warranties provided by the manufacturers of these components, which will be provided to you. You should review these third-party warranties closely to determine your rights.

How to Obtain Warranty Service: To submit a claim, this document and a signed and dated copy of the original Safe Step Walk In Tub Co. (“Safe Step”) Customer Remodeling and Improvement Agreement must be submitted in writing by registered mail to Safe Step at 1830 Air Lane Drive Suite 4, Nashville Tennessee 37210. Claims must be submitted promptly after discovery of the claimed defect and within the applicable warranty period. Upon receipt of a claim, an appointment will be scheduled within a reasonable period of time after having received the claim to inspect your warranty claim. If after inspection, it is determined that a valid claim exists under one or more of the warranties, the defective product or component will be repaired, re-installed, replaced, or a refund of the purchase price shall be paid. If Safe Step determines to replace your product or component and if the product or component as originally installed is no longer available, Safe Step or its representative shall have the right to substitute a product or component designated by Safe Step or its designated representative to be of equal quality. Replacement of your product or component does not renew the warranty period. If, at Safe Step option, a purchase price is refund is conveyed to you, then all warranties are terminated, and repair, replacement, or removal are valid unless and until you have made full payment under the Safe Step Customer Remodeling and Improvement Agreement and all addenda thereto. Non-warranty calls for repair or adjustment mat result in a service charge.

What Is Not Covered:  All warranties terminate immediately upon the transfer of home ownership. All warranties assume normal and reasonable use of your Safe Step walk-in tub. These warranties do not cover any other damage, workmanship, or material failure including, but no limited to, damage caused by occurrences beyond the control of Safe Step, such as settlement of the building, failure of the structure (including foundations and walls), use of incompatible accessories, removal, repair, or re-installation of your Safe Step walk-in tub or any component thereof by anyone other than Safe Step, corrosive effects of chemical pollutants, normal fading, fire, weather of catastrophic nature as defined by the U.S. National Weather Service, other acts of God, intentional acts, and/or unreasonable use or failure to provide reasonable maintenance. Installation, removal, painting, repair, adjustment, tampering, or re-installation of your Safe Step walk-in tub or any component thereof by anyone other than Safe Step voids any and all warranties within this document, and Safe Step expressly disclaims any liability for any costs, defects, or damages with respect to such actions. This warranty is not transferrable.

Remedies and Rights:  These warranties are the only express warranties provided. No person has authority to assume or incur any obligation, liability, or responsibility in place of or in addition to these warranties. IN NO EVENT SHALL THE DURATION OF ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE BE LONGER THAN THE EXPRESS WARRANTIES HEREIN. EXCEPT FOR THE WARRANTY PROVIDED HEREIN, NO WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE IS BEING MADE. SOME STATES DO NOT PERMIT ANY LIMITATION THE LENGTH OF AN IMPLIED WARRANTY, AND THEREFORE THE IMMEDIATELY PROCEDING SENTENCE MAY NOT APPLY. LIABILITY UNDER THIS WARRANTY IS LIMITED TO THE AMOUNT PAID BY THE CONSUMER PURCHASER AT THE TIME OF THE PURCHASE.  IN NO EVENT SHALL ANY PARTY BE OBLIGATED OR LIABLE FOR INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND FOR THE BREACH OF ANY EXPRESS OR IMPLIUED WARRANTY. SOME STATES DO NOT ALLOW EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, AND THEREFORE SOME OR ALL OF THE IMMEDIATELY PRECEDING SENTENCE MAY NOT APPLY. THESE WARRANTIES PROVIDE SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.
